Mason County Fiscal Court Regular Session July 13, 2010 9:00 a.m.
The meeting was called to Order by Judge/Executive James L. “Buddy” Gallenstein. Present were Commissioner Donald Tumey (District 3), Commissioner F. J. “Bear” Finn (District 2), Commissioner Patrick McKay IV (District 1), County Treasurer Kim Muse, and Assistant County Attorney, Jackie Wright. Media from The Ledger Independent and WFTM were also in attendance.
Motion by Commissioner McKay and seconded by Commissioner Finn to approve the minutes of the June 15, 2010 meeting as presented.
Judge Gallenstein advised the Court regarding the status of the Davis Lane Bridge Replacement. He stated that upon removal of the deck, it was discovered that the bridge was in substantially worse condition than was originally indicated. He has discussed its dangerous condition with the Department of Transportation and they have agreed to additional funding for the complete replacement of this bridge.
Motion by Commissioner McKay and seconded by Commissioner Tumey to authorize the County Judge/Executive to execute all necessary documentation provided by the Kentucky Department of Transportation relating to the replacement of the Davis Lane Bridge and to authorize the contractor, R & J Welding, to continue replacement of this structure.
Motion by Commissioner McKay and seconded by Commissioner Finn to accept the Monthly Tax Disbursements for June, 2010 in the amount of $3,624.39 as submitted by Sheriff Patrick Boggs.
Sheriff Boggs submitted the attached June, 2010 Monthly Vehicle Reports for review.
Judge Gallenstein provided an update to the Change Orders which have been submitted in the construction of the new Mason County Sheriff’s Office to be located at 120 West Third Street. These Change Orders include those necessary for the installation of floor drains, an access control system, interview room dvd recording system, additional insulation, and television security.
Detention Center Report
Motion by Commissioner McKay and seconded by Commissioner Finn to accept the June, 2010 Detention Center Report as presented by Jailer Gerald Curtis.
Motion by Commissioner McKay and seconded by Commissioner Finn to enter into a Memorandum of Understanding between Mason County Detention Center and Comprehend, Inc. regarding the operation of the Men’s Recovery Program.
Judge Gallenstein informed the Court that a $173,000 recycling grant had been received for the purchase of roll-off dumpsters, vertical balers and conveyors.
Motion by Commissioner Finn and seconded by Commissioner McKay to advertise for sealed bids for conveyor, sorting belt & lines, three 30 yard recycling roll-off dumpsters and three small rear feed vertical balers and to further authorize the payment of such upon bid acceptance and presentation of invoice.
Commissioner Finn notified those present at the meeting that an application for a $150,000 grant had been submitted for the construction of a new animal shelter. A tentative design for the proposed building has been drawn by DS2 Architects. Judge Gallenstein warned that this is a competitive grant and will be difficult, but not impossible, to obtain.
Building & Construction
Motion by Commissioner McKay and seconded by Commissioner Finn to accept the June, 2010, Building and Construction Report as presented.
Motion by Commissioner McKay and seconded by Commissioner Finn to approve Order 10-07 authorizing the County Treasurer to transfer the following from the General Fund, as needed:
$100,000 to LGEA Fund $200,000 to Jail Fund $50,000 to Solid Waste Fund $50,000 to Road Fund $100,000 to Landfill Fund
Motion by Commissioner McKay and seconded by Commissioner Finn to accept the Investments Journal in the total amount of $1,835,441.32 as of June 30, 2010 as presented by Treasurer Muse.
Motion by Commissioner McKay and seconded by Commissioner Finn to accept the County Treasurer’s 2009 - 2010 Annual Report as presented by County Treasurer Muse.
Motion by Commissioner Finn and seconded by Commissioner McKay to recess the regular meeting of the Mason County Fiscal Court and convene into a meeting of the Public Properties Corporation.

Motion by Director McKay and seconded by Director Finn to approve the Financial Statement for Fiscal Year 2009-10 as of June 30, 2010.

Motion by Director McKay and seconded by Director Tumey to accept the 2009-2010 Annual Settlement of the Mason County, Ky Public Properties Corporation as presented by Treasurer Muse.

Motion by Director Finn and seconded by Director McKay to adjourn the meeting of the Mason County, Kentucky Public Properties Corporation and return to regular session of the Mason County Fiscal Court.

Motion by Commissioner Finn and seconded by Commissioner McKay to accept the business of the Public Properties Corporation and to reopen the regular meeting of the Mason County Fiscal Court.
1. Buffalo Trace District Health Department Service Agreement Motion was made by Commissioner McKay and seconded by Commissioner Finn to enter into a Business Associate Agreement with the Buffalo Trace District Health Department with regard to the proper management of Protected Health Information and to enter into Service Agreeements with same for the purchase of Tuberculosis Skin Tests and Hepatitis B vaccines.
1. Western Mason Water District Board Appointment Motion was made by Commissioner Finn and seconded by Commissioner McKay to approve the reappointment of Pam Carpenter to the board of the Western Mason Water District. This appointment is for a four year term and will expire June 30, 2014.
2. Maysville – Mason County Planning Commission Board Appointment Motion was made by Commissioner McKay and seconded by Commissioner Finn to approve the reappointment of Emmitt Poe to the board of the Maysville-Mason County Planning Commission. This appointment is for a four year term and will expire July, 2014.
There being no further business, motion was made by Commissioner Finn and seconded by Commissioner McKay to adjourn the July 13, 2010 meeting of the Mason County Fiscal Court.
