Mason County Fiscal Court Regular Session June 15, 2010 9:00 a.m.
The meeting was called to Order by Judge/Executive James L. “Buddy” Gallenstein. Present were Commissioner Donald Tumey (District 3), Commissioner F. J. “Bear” Finn (District 2), Commissioner Patrick McKay IV (District 1), Sheriff Patrick Boggs, County County Attorney John F. Estill, Assistant County Attorney Jackie Wright and County Treasurer, Kim Muse. Media from The Ledger Independent was also in attendance.
Motion by Commissioner McKay and seconded by Commissioner Finn to approve the minutes of the May 11, 2010 meeting as presented.
Motion by Commissioner Finn and seconded by Commissioner Tumey to accept the 2010 Tax Year Monthly Tax Disbursements in the amount of $954.25 for May, 2010 as submitted by Sheriff Patrick Boggs.
Motion by Commissioner Finn and seconded by Commissioner McKay to accept the proposal submitted by PRO OnCall Technologies for a telephone system to be installed at the new Mason County Sheriff Office and Child Support Enforcement Office building located at 120 West Third Street. The cost breakdown is as follows:
Overhead Paging -$1,140.00 Phone System –$8,447.00 Wiring-$5,895.00 Total Cost-$15,482.00
(Child Support Enforcement is to pay $4,218.24 for their respective portion of the total cost)
Motion by Commissioner Finn and seconded by Commissioner McKay to approve Resolution 10-13 authorizing the Judge/Executive and County Treasurer to execute all necessary documentation to enter into an unsecured loan agreement with the Bank of Maysville in the amount of $200,000 for the remodel / construction of the new Mason County Sheriff’s and Child Enforcement offices.
Motion by Commissioner McKay and seconded by Commissioner Finn to accept the Mason County Detention Center Policy and Procedures Manual as revised, effective June 1, 2010 and further approved by County Attorney John F. Estill.
Motion by Commissioner McKay and seconded by Commissioner Finn to approve Resolution 10-12 authorizing the Judge/Executive and County Treasurer to execute all necessary documentation to enter into an unsecured loan agreement with the Bank of Maysville in the amount of $250,000 for the purpose of funding the completion of Phase IV and Phase V of the Maysville-Mason County Landfill.
Motion by Commissioner McKay and seconded by Commissioner Tumey to enter into a lease agreement with Modern Office Methods for a Lanier LD430c copier at a monthly payment of $226.42.
Judge Gallenstein advised the Court that two proposals were received for the repair of concrete at the Mason County Recycling Center. Those proposals were:
Bond Family Construction-$1,150.00 Myrick Construction-$1,650.00
Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the proposal from Bond Family Construction in the amount of $1,150.00.
On April 23, 2010, letters were sent to local veterinarians requesting proposals for euthanasia services at the Animal Shelter. The County Judge disclosed to the Court that the only veterinarian responding was J.T. Williams, DVM, of Colonial Heights Veterinary Service, who is the son in law of the Judge/Executive. All though services were solicited from a number of veterinarians, no other veterinary responded, and the services of a veterinarian are required to lawfully euthanize animals at the Animal Shelter. County Attorney Estill advised that the identical issue has existed in the past, and Dr. Williams proposal was referred to the Mason County Ethics Committee, which opined that although a technical conflict of interest existed, that the contract was appropriate as there were no other proposals, the proposal was reasonable, and the services were necessary.
Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the proposal submitted by J.T. Williams, DVM, effective from July 1, 2010 through June 30, 2011 (with a one year renewable option) for euthanasia services at the Mason County Animal Shelter. The proposal is attached hereto and incorporated herein by reference.
Motion by Commissioner Finn and seconded by Commissioner McKay to approve Order 10-06 regarding the transfer of $30,000 from the General Fund to the LGEA Fund as needed.
Motion by Commissioner Tumey and seconded by Commissioner Finn to authorize the County Treasurer to make line item budget, cash, and interfund transfers as needed for Fiscal Year 2010-2011.
The County Treasurer advised the Court that KRS 64.530(1) required the Fiscal Court to fix the “reasonable compensation” of its employees, other than certain exempted officers and/or elected officials. Judge/Executive Gallenstein read into the record the salaries of all County employees subject to the statutory requirements, and submitted a listing of such employees and salaries to the Fiscal Court Clerk, to be appended to the minutes.
Motion by Commissioner Tumey and seconded by Commissioner McKay to fix the 2010-2011 Mason County Fiscal Court salaries as presented by County Treasurer, Kim Muse, and as set forth in the exhibit which is incorporated herein be reference.
Motion by Commissioner McKay and seconded by Commissioner Finn to declare the following vehicles / equipment as surplus and are to be sold at public auction on Saturday, June 19, 2010:

On this date, Mason County Fiscal Court held the 2nd Reading of Ordinance 10-03.
Motion by Commissioner McKay and seconded by Commissioner Finn to adopt Ordinance 10-03 affirming the findings fact of the Maysville-Mason County Joint Planning Commission pertaining to map amendments rezoning a 43 +/- parcel owned by R.E. Huber on the south side of Kentucky 11 from A-1 (Agricultural Transition) to RR-2 (Rural Residential without Public Sewer) and amending Ordinance No. 02-07 as recommended, provided that the Judge/Executive investigate the appropriateness of construction of a road across a dam on the property and obtain engineering studies on proper construction of such road before the plat is signed.
There being no further business, motion was made by Commissioner Finn and seconded by Commissioner McKay to adjourn the June 15, 2010 meeting of the Mason County Fiscal Court.
