Mason County Fiscal Court Regular Session May 11, 2010 9:00 a.m.
The meeting was called to Order by Judge/Executive James L. Buddy Gallenstein. Present were Commissioner Donald Tumey (District 3), Commissioner F. J. Bear Finn (District 2), Commissioner Patrick McKay IV (District 1), Sheriff Patrick Boggs, County Treasurer Kim Muse, and County Attorney John F. Estill. Media from The Ledger Independent was also in attendance.
Motion by Commissioner McKay and seconded by Commissioner Finn to approve the minutes of the April 13, 2010 meeting as presented.
Motion by Commissioner Finn and seconded by Commissioner McKay to approve <>B to enter into an agreement with the Kentucky Department of Transportation regarding the resurfacing of Key Pike at a reimbursable cost of approximately $116,000.00.
Motion by Commissioner Finn and seconded by Commissioner Tumey to accept the bids submitted by J & E Construction and E & E Construction for the replacement of the Johnson Lane Bridge. Award of contract to either shall be contingent upon the approval and recommendation from the Kentucky Department of Transportation.
Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the bid submitted by R & J Welding for the replacement of the Davis Lane Bridge in the amount of $38,830 and to further authorize the purchase of additional I-Beams as needed at a cost of $37 per foot.
Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the bid submitted by Holt Equipment for a 2010 John Deere 310SJ in the amount of $65,300.00 and to further authorize the County Judge/Executive and County Treasurer to issue payment upon receipt of equipment.
Motion by Commissioner McKay and seconded by Commissioner Finn to accept the 2009 Tax Year Monthly Tax Disbursements in the amount of $49,252.10 for April, 2010 as submitted by Sheriff Patrick Boggs.
Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the 2009 Tax Settlement with the Mason County Fiscal Court as presented by Sheriff Patrick Boggs.
Sheriff Boggs submitted the attached April, 2010 Monthly Vehicle Report for review.
Darin S. Schweickart, with DS2 Architects, appeared before the Court to recapitulate the bids received for the renovation of the new Mason County Sheriffs Office (formerly known as the Mason County Health Department located at 120 West Third Street).
Motion by Commissioner Finn and seconded by Commissioner McKay to accept the bid submitted by Maher Electric in the amount of $199,500 (without demolition); to authorize the County Judge/Executive, pending the approval of the County Attorney, to sign all necessary documentation; and to further authorize the County Judge/Executive and County Treasurer to secure financial arrangements for payment.
Motion by Commissioner Tumey and seconded by Commissioner Finn to authorize the County Judge/Executive to enter into an agreement with Global Environmental Services for the disposal of computers and televisions.
Motion by Commissioner Finn and seconded by Commissioner McKay to approve Order 10-05 regarding the transfer of $30,000 from the General Fund to the Solid Waste Fund.
The minutes of the LGEA/Road Aid public hearing held on May 3, 2010 were made a matter of record.
On this date, County Judge/Executive James Gallenstein and County Treasurer Kim Muse presented the 2nd Reading of Ordinance 10-02 regarding the 2010-11 Budget of Mason County Fiscal Court which shows a total budget of $13,036,979.28 as follows in summary:
General Fund - $2,879,859.00 Road Fund - $1,126,990.28 Jail Fund - $2,459.930.00 LGEA Fund - $ 429,300.00 State Grants - $ 52,000.00 Federal Grants - $ 100,900.00 Solid Waste Fund - $ 345,100.00 Landfill Fund - $5,112,500.00 Garbage Collections - $ 530,400.00
Motion by Commissioner McKay and seconded by Commissioner Finn to adopt Ordinance 10-02.
Motion by Commissioner McKay and seconded by Commissioner Finn to approve Resolution 10-11 regarding the establishment of maximum salaries for county officers.
1. On this date, Mason County Fiscal Court held 1st reading of Ordinance 10-03 affirming the findings fact of the Maysville-Mason County Joint Planning Commmission pertaining to map amendments rezoning a 43 +/- parcel owned by R.E. Huber on the south side of Kentucky 11 from A-1 (Agricultural Transition) to RR-2 (Rural Residential without Public Sewer) and amending Ordinance No. 02-07 as recommended.
2. Motion by Commissioner McKay and seconded by Commissioner Tumey to adopt Resolution 10-09 authorizing the Judge/Executive to make application for, and, upon approval, to enter into an agreement with the Kentucky Office of Homeland Security (KOHS), to execute any documents which are deemed necessary by KOHS to facilitate and administer the project and to act as the authorized correspondent for this project.
3. Motion by Commissioner Tumey and seconded by Commissioner McKay to authorize the renewal of employee health insurance through Kentucky Association of Counties at a projected monthly premium of $59,453.20.
4. Motion by Commissioner McKay and seconded by Commissioner Tumey to enter into an Agreement with Commonwealth of Kentucky Court of Justice for reimbursement in the annual amount of $132,720 relating to Justice Center expenses for Fiscal Year 2010 2011.
5. Motion by Commissioner Tumey and seconded by Commissioner McKay to reappoint Jeff Schumacher to a four year term on the board of the Maysville-Mason County Port Authority. Term will expire in May, 2014.
7. Motion by Commissioner McKay and seconded by Commissioner Tumey to reappoint Bob Drake to a four year term on the board of the Fleming-Mason Airport. Term will expire in May, 2014.
8. Motion by Commissioner Tumey and seconded by Commissioner McKay to appoint Todd White and Kent Butcher to four year terms on the board of the Mason County Library. Terms will expire in June, 2014.
9. Motion by Commissioner Finn and seconded by Commissioner McKay to appoint Kim Mahaffey to fill the unexpired term of Anthony Wenz on the Mason County Cooperative Extension District Board which will expire in January, 2012 and to appoint Marilyn Berry to a three year term on the Board, retroactive to January, 2010.
10. Motion by Commissioner Finn and seconded by Commissioner McKay to authorize the County Judge/Executive to enter into a third Tolling Agreement for claims under the Comprehensive Environmental Response, Compensation & Liability Act relating to the Cooksey Brothers Landfill Fire Superfund site.
There being no further business, motion was made by Commissioner Finn and seconded by Commissioner McKay to adjourn the May 11, 2010 meeting of the Mason County Fiscal Court.
