Mason County Fiscal Court Regular Session April 13, 2010 9:00 a.m.
The meeting was called to Order by Judge/Executive James L. Buddy Gallenstein. Present were Commissioner Donald Tumey (District 3), Commissioner F. J. Bear Finn (District 2), Commissioner Patrick McKay IV (District 1), County Treasurer Kim Muse, County Attorney John F. Estill and Assistant County Attorney, Jackie Wright. Media from The Ledger Independent and WFTM were also in attendance.
Motion by Commissioner McKay and seconded by Commissioner Tumey to approve the minutes of the March 16, 2010 meeting as presented.
Deanna Jessie, Community Organizer, appeared before the County to provide an overview of the Kentucky Prescription Assistance Program that was created in October, 2008 under House Bill 406. In addition, she urged Mason Countys participation and identified Lindsay Neff as Mason Countys local coordinator.
Road Department
Motion by Commissioner Tumey and seconded by Commissioner McKay to accept the Road Department Report as presented.
Motion by Commissioner Tumey and seconded by Commissioner McKay to approve Resolution 10-06 adopting and approving the execution of a County Road Aid Cooperative program contract in the amount of $381,735.00 between Mason Fiscal Court and the Commonwealth of Kentucky Transportation Cabinet.
Motion by Commissioner McKay and seconded by Commissioner Finn to approve Resolution 10-07 adopting and approving the execution of a rural secondary agreement in the amount of $73,840.00 between Mason Fiscal Court and the Commonwealth of Kentucky Transportation Cabinet for the construction of a bridge and approaches on Johnson Lane.
Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the Road Commission bids as presented for corrugated metal pipe, bituminous materials, aggregate, transports, fuel, rock salt, cold mix asphalt and chip/seal materials.
Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the Monthly Tax Disbursements in the amount of $325,168.54 for March, 2010 as submitted by Sheriff Patrick Boggs.
Sheriff Boggs submitted the attached March, 2010 Monthly Vehicle Reports for review.
County Attorney John Estill advised the Court that Tim Fegan has recently been appointed Executive Director of Buffalo Trace / Gateway Narcotics Tax Force.
Detention Center
Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the Detention Center Report as presented by Jailer Gerald Curtis.
Mr. Leonard presented a tabulation of Landfill Gas / Leachate Technician, Scale Maintenance Technician and Scale Technician bids which were received on April 9, 2010. Upon Mr. Leonards recommendation, motion was made by Commissioner Finn and seconded by Commissioner McKay to award the following bids:
Landfill Gas and Leachate Technician M & M Electric, $40 per hour Scale Technician M & M Electric, $40 per hour Electrician Services M & M Electric, $40 per hour
Due to a typographical error on the Tetra Tech agreement that was approved at the March 16, 2010 meeting of the Mason County Fiscal Court, motion was made by Commissioner McKay and seconded by Commissioner Tumey to correct the amount approved for the agreement to $39,020.
Motion by Commissioner Finn and seconded by Commissioner McKay to approve the agreement on recyclables between Mason County Fiscal Court and Rumpke Recycling, Inc.
Motion by Commissioner Tumey and seconded by Commissioner Finn to accept the Quarterly Financial Statement as presented by the County Treasurer as of March 31, 2010.
Motion by Commissioner Finn and seconded by Commissioner Tumey to approve Order No. 10-04 authorizing the County Treasurer to transfer $20,000 from General Fund to Solid Waste Fund and $2,285 from General Fund to Federal Fund as needed.
Motion by Commissioner McKay and seconded by Commissioner Finn to accept the Investment Journal totaling $1,835,441.32 as of March 31, 2009 in accordance with the Investment Policy.
Motion by Commissioner Finn and seconded by Commissioner McKay to approve the Annual Standing Order to preapprove certain recurring expenses including debt service payments for the Mason County Public Properties Corporation for the Fiscal Year 2010-2011 pursuant to KRS 68.275(3).
On this date, County Judge/Executive James Gallenstein and County Treasurer Kim Muse presented the 1st Reading of the 2010-11 Budget of Mason County Fiscal Court which shows a total budget of $12,873,289.00 as follows in summary:
General Fund - $2,879,859 Road Fund - $1,103,300 Jail Fund - $2,459,930 LGEA Fund - $ 429,300 State Grants - $ 52,000 Federal Grants - $ 100,900 Solid Waste Fund - $ 345,100 Landfill Fund - $4,972,500 Garbage Collections - $ 530,400
Motion by Commissioner Finn and seconded by Commissioner Tumey to recess the regular meeting of the Mason County Fiscal Court and go into a meeting of the Mason County, Kentucky Public Properties Corporation.

Motion by Director McKay and seconded by Director Finn accept the Financial Statement of the Kentucky Public Properties Corporation as of March 31, 2010 and showing a cash balance of $253,211.13

Motion by Commissioner McKay and seconded by Commissioner Finn to accept the business of the Public Properties Corporation and to reopen the regular meeting of the Mason County Fiscal Court.
1. Resolution 10-08 Transportation of Non-Public School Students
Motion by Commissioner Finn and seconded by Commissioner McKay to approve Resolution 10-08 pertaining to costs arising from the Transportation of Non-Public School Students and to authorize payment, not to exceed $25,000, to the Mason County School Board when invoiced.
1. Mason County Cooperative Extension Service Motion by Commissioner McKay and seconded by Commissioner Finn to accept the Annual Plan of Work and 2010-2011 budget as submitted for the Mason County Cooperative Extension Service.
There being no further business, motion was made by Commissioner Finn and seconded by Commissioner McKay to adjourn the April 13, 2010 meeting of the Mason County Fiscal Court.
