Mason County Fiscal Court Special Session March 16, 2010 9:00 a.m.
The meeting was called to Order by Judge/Executive James L. “Buddy” Gallenstein. Present were Commissioner Donald Tumey (District 3), Commissioner F. J. “Bear” Finn (District 2), Commissioner Patrick McKay IV (District 1), Sheriff Patrick Boggs, County Treasurer Kim Muse, County Attorney John F. Estill and Assistant County Attorney, Jackie Wright. Media from The Ledger Independent and WFTM were also in attendance.
Motion by Commissioner McKay and seconded by Commissioner Finn to approve the minutes of the February 9 and February 26, 2010 meetings as presented.
Motion by Commissioner Finn and seconded by Commissioner McKay to approve Resolution 10-03 accepting title, ownership, maintenance and operations of a portion of Parry Lane and its placement into the County Road System.
Special Guest – Mrs. Sue Porter of Public Entity Insurance
Ms. Sue Porter appeared before the Court on behalf of KACo’s insurance program to present a dividend check in the amount of $11,227.72 which represents Mason County’s share of a $3,000,000 surplus for FY 2005-2006 regarding property and liability coverage.
Sheriff
Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the Monthly Tax Disbursements in the amount of $181,398.24 for February, 2010 as submitted by Sheriff Patrick Boggs.
Pursuant to KRS 441.215, Jailer Gerald Curtis presented the 2010-2011 proposed budget for the Mason County Detention Center showing total receipts and expenditures of $2.259,930.00.
Landfill
Motion by Commissioner Finn and seconded by Commissioner Tumey to accept the Landfill Report as presented by Todd Leonard, Landfill Manager.
Motion by Commissioner Finn and seconded by Commissioner Tumey to enter into a Professional Services Agreement with Tetra Tech, Inc. to perform Phase 3 Construction Quality Assurances services at a cost of $30,020.00.
Motion by Commissioner McKay and seconded by Commissioner Finn to authorize Judge/Executive Gallenstein, upon approval of the Landfill Manager, to sign all necessary documentation for Kanawha Stone to proceed with Landfill Phase 3.
Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the Financial Statements as presented by the County Treasurer as of February 28, 2010.
Motion by Commissioner McKay and seconded by Commissioner Finn to authorize the County Treasurer to pay all invoices, not to exceed $948,722.40, from Kanawha Stone pursuant to the Landfill D P & L Phase 3 construction project.
There being no further business, motion was made by Commissioner McKay and seconded by Commissioner Finn to adjourn the March 16, 2010 meeting of the Mason County Fiscal Court.
