Minutes - March 16, 2010 By: Amy Asher, Deputy Judge/Executive & Fiscal Court Clerk Submitted: 3/17/2010 Mason County Fiscal Court Special Session March 16, 2010 9:00 a.m. The meeting was called to Order by Judge/Executive James L. “Buddy” Gallenstein. Present were Commissioner Donald Tumey (District 3), Commissioner F. J. “Bear” Finn (District 2), Commissioner Patrick McKay IV (District 1), Sheriff Patrick Boggs, County Treasurer Kim Muse, County Attorney John F. Estill and Assistant County Attorney, Jackie Wright. Media from The Ledger Independent and WFTM were also in attendance. Motion by Commissioner McKay and seconded by Commissioner Finn to approve the minutes of the February 9 and February 26, 2010 meetings as presented. Commissioner Tumey - Yes Commissioner Finn - Yes Commissioner McKay - Yes Judge/Executive Gallenstein - Yes Road Department Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the Road Department Report as presented. Commissioner Tumey - Yes Commissioner Finn - Yes Commissioner McKay - Yes Judge/Executive Gallenstein - Yes Motion by Commissioner Finn and seconded by Commissioner McKay to approve Resolution 10-03 accepting title, ownership, maintenance and operations of a portion of Parry Lane and its placement into the County Road System. Commissioner Tumey - Yes Commissioner Finn - Yes Commissioner McKay - Yes Judge/Executive Gallenstein - Yes Special Guest – Mrs. Sue Porter of Public Entity Insurance Ms. Sue Porter appeared before the Court on behalf of KACo’s insurance program to present a dividend check in the amount of $11,227.72 which represents Mason County’s share of a $3,000,000 surplus for FY 2005-2006 regarding property and liability coverage. Sheriff Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the Monthly Tax Disbursements in the amount of $181,398.24 for February, 2010 as submitted by Sheriff Patrick Boggs. Commissioner Tumey - Yes Commissioner Finn - Yes Commissioner McKay - Yes Judge/Executive Gallenstein - Yes Sheriff Boggs submitted the attached February, 2010 Monthly Vehicle Report for review. Detention Center Motion by Commissioner McKay and seconded by Commissioner Finn to accept the Detention Center Report as presented by Jailer Gerald Curtis. Commissioner Tumey - Yes Commissioner Finn - Yes Commissioner McKay - Yes Judge/Executive Gallenstein – Yes Pursuant to KRS 441.215, Jailer Gerald Curtis presented the 2010-2011 proposed budget for the Mason County Detention Center showing total receipts and expenditures of $2.259,930.00. Landfill Motion by Commissioner Finn and seconded by Commissioner Tumey to accept the Landfill Report as presented by Todd Leonard, Landfill Manager. Commissioner Tumey - Yes Commissioner Finn - Yes Commissioner McKay - Yes Judge/Executive Gallenstein – Yes Motion by Commissioner Finn and seconded by Commissioner Tumey to enter into a Professional Services Agreement with Tetra Tech, Inc. to perform Phase 3 Construction Quality Assurances services at a cost of $30,020.00. Commissioner Tumey - Yes Commissioner Finn - Yes Commissioner McKay - Yes Judge/Executive Gallenstein – Yes Motion by Commissioner McKay and seconded by Commissioner Finn to authorize Judge/Executive Gallenstein, upon approval of the Landfill Manager, to sign all necessary documentation for Kanawha Stone to proceed with Landfill Phase 3. Commissioner Tumey - Yes Commissioner Finn - Yes Commissioner McKay - Yes Judge/Executive Gallenstein - Yes Recycling Center Motion by Commissioner Finn and seconded by Commissioner McKay to accept the Recycling Center Report as presented. Commissioner Tumey - Yes Commissioner Finn - Yes Commissioner McKay - Yes Judge/Executive Gallenstein - Yes Animal Shelter Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the Animal Shelter report as presented and attached hereto. Commissioner Tumey - Yes Commissioner Finn - Yes Commissioner McKay - Yes Judge/Executive Gallenstein – Yes Building & Construction Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the February, 2010 Building and Construction Report as presented. Commissioner Tumey - Yes Commissioner Finn - Yes Commissioner McKay - Yes Judge/Executive Gallenstein – Yes County Treasurer Motion by Commissioner Tumey and seconded by Commissioner Finn to authorize budget transfers in the amount of $38,500.00. Exhibit attached. Commissioner Finn – Yes Commissioner Tumey - Yes Commissioner McKay - Yes Judge/Executive Gallenstein - Yes Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the Financial Statements as presented by the County Treasurer as of February 28, 2010. Commissioner Tumey - Yes Commissioner Finn - Yes Commissioner McKay - Yes Judge/Executive Gallenstein - Yes Motion by Commissioner McKay and seconded by Commissioner Finn to pay claims, plus the additional claims, as presented. Commissioner Tumey - Yes Commissioner Finn - Yes Commissioner McKay - Yes Judge/Executive Gallenstein - Yes Motion by Commissioner Finn and seconded by Commissioner Tumey to pay Limestone Produce in the amount of $84.50. Commissioner Tumey - Yes Commissioner Finn - Yes Commissioner McKay - Abstained Judge/Executive Gallenstein - Yes Motion by Commissioner McKay and seconded by Commissioner Finn to authorize the County Treasurer to pay all invoices, not to exceed $948,722.40, from Kanawha Stone pursuant to the Landfill D P & L Phase 3 construction project. Commissioner Tumey - Yes Commissioner Finn - Yes Commissioner McKay - Yes Judge/Executive Gallenstein – Yes Motion by Commissioner McKay and seconded by Commissioner Tumey to approve the following renewable contracts totaling $2,849.49: 1. Siemens – annual fire alarm service contract for the Justice Center in the amount of $1,498.00 2. Jefferson Audio Video Systems, Inc. – annual maintenance contract for the Jail in the amount of $750.00 3. Pro On Call Technologies – annual voicemail system maintenance contract for the Jail in the amount of $339.49 4. Simplex Grinnell – annual sprinkler inspection renewal contract for the Jail in the amount of $262.00.
