Mason County Fiscal Court Regular Session February 9, 2010 9:00 a.m.
The meeting was called to Order by Judge/Executive James L. “Buddy” Gallenstein. Present were Commissioner Donald Tumey (District 3), Commissioner F. J. “Bear” Finn (District 2), Commissioner Patrick McKay IV (District 1), Sheriff Patrick Boggs, County Treasurer Kim Muse, and County Attorney John F. Estill.
Motion by Commissioner McKay and seconded by Commissioner Tumey to approve the minutes of the January 12, 2009 meeting with one correction on Page 3 to correct Commissioner McKay’s vote from “No” to “Yes” with regard to the purchase of a 2010 Ford Police Interceptor..
County Clerk 2009 Settlement Frances Cotterill, Mason County Clerk, presented the County Clerk Final Settlement for Calendar Year 2009. The settlement depicted total receipts in the amount of $3,363,497.22, total disbursements of $3,286,366.65, leaving excess receipts due the county of $77,130.57. Ms. Cotterill presented the Treasurer with Check No. 3183 in the amount of $65,000.00 with the remaining balance of $12,130.57 to be paid after the audit.
Motion by Commissioner Finn and seconded by Commissioner McKay to accept the 2009 Final Settlement as presented by the Mason County Clerk, Frances Cotterill.
Acceptance of East Parry Lane and West Parry Lane into the county road system (Resolution 10-03) was tabled until a deed has been received from the State Highway Department.
Sheriff
Motion by Commissioner McKay and seconded by Commissioner Finn to accept the Monthly Tax Disbursements in the amount of $497,467.24 for January, 2010 as submitted by Sheriff Patrick Boggs.
Sheriff Patrick Boggs presented the Sheriff’s Final Settlement for Calendar Year 2009. The settlement depicted total receipts in the amount of $893,747.39, total disbursements of $840,788.17 leaving excess receipts due the county of $52,959.22. Sheriff Boggs presented the Treasurer with Check No. 1765 in the amount of $52,959.22.
Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the 2009 Final Settlement as presented by the Mason County Sheriff, Patrick Boggs.
Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the January, 2010 Detention Center Report as presented by Jailer Gerald Curtis.
Motion by Commissioner Finn and seconded by Commissioner McKay to declare the following list of vehicles as junk and to allow the vehicles to be disposed as is appropriate:

Motion by Commissioner McKay and seconded by Commissioner Finn to approve Order 10-02 regarding the transfer of $150,000 from General Fund to Jail Fund, and $30,000 from General Fund to Solid Waste Fund as needed.
1. Buffalo Trace / Gateway Narcotics Task Force Motion by Commissioner Finn and seconded by Commissioner McKay to approve Resolution 10-02 in support of the Buffalo Trace / Gateway Narcotics Task Force and to further provide up to $5,494.07 toward the match of any federal or state funds to assist in the continuation of this worthwhile enforcement unit.
2. Buffalo Trace Area Development Agreement Motion by Commissioner McKay and seconded by Commissioner Finn to enter into an agreement between the Mason County Fiscal Court and Buffalo Trace Area Development District for the purpose of directing BTADD to complete GPS and GIS mapping of the Western Mason Sanitation District.
3. Emergency Management / Rescue Squad Affiliation Executive Order Motion by Commissioner Finn and seconded by Commissioner McKay to approve Executive Order 10-03 pursuant to the establishment of responsibilities and chain of command between Mason County Government, Mason County Emergency Management Director and Mason County Rescue Squad in the provision of rescue squad services.
4. Waste Tire Trust Fund Motion by Commissioner Finn and seconded by Commissioner McKay to approve Resolution 10-04 in support of the Waste Tire Trust Fund which provides Kentucky counties with a means for the management and removal of scrap tires.
5. Old Health Department Building / New Sheriff’s Office Motion by Commissioner McKay and seconded by Commissioner Tumey to authorize Judge Gallenstein to engage DS2 Architects in the preparation of a bid packet relative to the rehabilitation of the Old Health Department Building for use as the Mason County Sheriff’s Office and to further allow for the advertisement of bids
6. Limestone Cable Vision Judge Gallenstein advised court members that he had been notified that, effective April 1, 2010, cable rates would increase.
7. Meeting Date Change Due to a scheduling conflict, motion was made by Commissioner McKay and seconded by Commissioner Finn to cancel the March 9 regular meeting of the Mason County Fiscal Court and to schedule a special session for March 16, 2010.
There being no further business, motion was made by Commissioner Finn and seconded by Commissioner Tumey to adjourn the February 9, 2010 meeting of the Mason County Fiscal Court.
