Mason County Fiscal Court Regular Session January 12, 2010 9:00 a.m.
The meeting was called to Order by Judge/Executive James L. Buddy Gallenstein. Present were Commissioner Donald Tumey (District 3), Commissioner F. J. Bear Finn (District 2), Commissioner Patrick McKay IV (District 1), Sheriff Patrick Boggs, County Treasurer Kim Muse, County Attorney John F. Estill and Assistant County Attorney Jackie Wright. Media from The Ledger Independent and WFTM was also in attendance.
Motion by Commissioner Finn and seconded by Commissioner Tumey to approve the minutes of the December 15, 2009 and December 18, 2009 meetings as presented.
On this date, Mason County Fiscal Court held 2nd Reading of Ordinance 10-01 requiring mandatory connection for all property owners within 300 feet of a road or right-of-way containing a sewage collection system; and otherwise amending Ordinance 03-04.
Kevin Cornette, Economic Development Director for Buffalo Trace Area Development District, was present to recapitulate the project from its inception. He discussed the code of federal regulations requiring mandatory connection pursuant to health and environmental standards. He further advised that 40% of project costs were in loan fund dollars which had to be repaid.
Judge Gallenstein opened the floor to allow those affected property owners present an opportunity to state their opposition. Those opposing the passage of Ordinance 10-01 included Woodie Insko, Kathy Insko, Mary Insko and Charles Tolle.
County Attorney Estill spoke of the need for consistent enforcement of this Ordinance and suggested that a person or persons (independent of the Western Mason Sanitation Board) perform an audit of the systems connections to identify those in non-compliance.
Kim Mullikin, member of the Sanitation Board, summarized the history of and benefits of connection. She also advised those present that the Sanitation Board meets the last Tuesday of every month.
No further comments were received from the public in attendance.
Motion by Commissioner McKay and seconded by Commissioner Finn to adopt Ordinance 10-01.
Motion by Commissioner Finn and seconded by Commissioner McKay authorizing Judge/Executive Gallenstein to contract with Buffalo Trace Area Development District (or other such independent persons) to perform an audit to identify connections to the sanitation system.
Court members commended the Road Department for their work regarding recent snow removal activity.
Sheriff
Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the Monthly Tax Disbursements in the amount of $1,392,093.27 for December, 2000 as submitted by Sheriff Patrick Boggs.
Sheriff Boggs submitted the attached December, 2009 Monthly Vehicle Report for review.
Sheriff Boggs presented a proposal from Countryside Motors, pursuant to the Kentucky State Price Contract, for a 2010 Ford Police Interceptor in the amount of $20,868.
Motion by Commissioner Finn and seconded by Commissioner McKay to approve the purchase of a 2010 Ford Police Interceptor in the amount of $20,868.00 from Countryside Motors in Lawrenceburg, Kentucky and to make payment of such upon receipt of an invoice.

Detention Center Report
Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the December, 2009 Detention Center Report as presented by Jailer Gerald Curtis.
Motion by Commissioner McKay and seconded by Commissioner Tumey to accept the December, 2009 Landfill Report as presented by Todd Leonard, Landfill Manager.
Motion by Commissioner Tumey and seconded by Commissioner Finn to allow Mr. Leonard and Judge/Executive Gallenstein to attend the Solid Waste Association of North Americas Landfill Gas Symposium in San Diego, California on March 8-11, 2010 and to authorize payment for such.
The payment of Account No. 410 is seriously delinquent. As this account has been on record since August, 2007 and the accountholder cannot be located, motion was made by Commissioner McKay and seconded by Commissioner Finn to declare Account 410 as uncollectible and further authorize its balance of $1330.67 to be written off of the accounts receivable records.
Motion by Commissioner McKay and seconded by Commissioner Finn to approve Order 10-01 regarding the transfer of $150,000 from General Fund to Jail Fund, $75,000 from General Fund to Federal Fund and $25,000 from General Fund to Solid Waste Fund as needed.
Motion by Commissioner Finn and seconded by Commissioner McKay to accept the Quarterly Investment Journal as of December 31, 2009 as presented by County Treasurer Muse.
Motion by Commissioner Finn and seconded by Commissioner McKay to recess the regular meeting of the Mason County Fiscal Court and go into a meeting of the Mason County, Kentucky Public Properties Corporation.

Motion by Judge/Executive Gallenstein and seconded by Commissioner McKay to accept the business of the Public Properties Corporation and to reopen the regular meeting of the Mason County Fiscal Court.
1. Siemens Contract Motion by Commissioner McKay and seconded by Commissioner Finn to renew the annual contract with Siemens for alarm monitoring at the Mason County Justice Center. The contract renewal amount is $420.00.
2. Resolution 10-01 Motion by Commissioner Finn and seconded by Commissioner McKay to adopt Resolution 10-01 pertaining to the intention of Mason County Fiscal Court to make application to the Department for Local Government for assistance under the Land and Water Conservation Fund for the purpose of renovating the Lewisburg Lions Club gymnasium for recreational purposes.
There being no further business, motion was made by Commissioner Finn and seconded by Commissioner Tumey to adjourn the January 12, 2010 meeting of the Mason County Fiscal Court.
