Mason County Fiscal Court Regular Session October 13, 2009 9:00 a.m.
The meeting was called to Order by Judge/Executive James L. Buddy Gallenstein. Present were Commissioner Don Tumey (District 3), Commissioner F. J. Bear Finn (District 2), Sheriff Patrick Boggs, County Treasurer Kim Muse, and Assistant County Attorney Jackie Sue Wright. Media from The Ledger Independent was also in attendance.
Motion by Commissioner Finn and seconded by Commissioner Tumey to approve the minutes of the September 15, 2009 meetings as presented.
Motion by Commissioner Tumey and seconded by Commissioner Finn to adopt Resolution 09-19 to enter into a Road Aid Agreement in the amount of $124,752 with the Department of Transportation for the purpose of resurfacing the following county roads: Woodburn Avenue, Classic Drive, Flora Drive, Fernleaf Drive, Highland Drive, Walton Pike and Big Pond Pike.
Motion by Commissioner Finn and seconded by Commissioner Tumey to adopt Resolution 09-20 accepting Conway Lane East (formerly known as Cedar Hill Road) into the County Road System.
On this date, Mason County Fiscal Court held First Reading of Ordinance 09-05 enabling the Office of the Mason County Judge/Executive to establish and declare various levels of snow emergencies, the conditions constituting such levels along with advisory announcements for media and setting forth fines for violation of certain provisions of such ordinance.

Motion by Commissioner Finn and seconded by Commissioner Tumey to authorize budget transfers in the amount of $37,600 as presented. Exhibit attached.
County Treasurer, Kim Muse, presented the Investments Journal for the period extending from from July 1, 2009 through September 30, 2009.
Motion by Commissioner Finn and seconded by Commissioner Tumey to recess the regular meeting of the Mason County Fiscal Court and go into a meeting of the Mason County, Kentucky Public Properties Corporation.

Motion by Director Finn and seconded by Commissioner Tumey to approve the Mason County, Kentucky Public Properties Corporation Financial Statement for Fiscal Year 2009-10 as of September 30, 2009.

Motion by Director Finn and seconded by Director Tumey to adjourn the meeting of the Mason County, Kentucky Public Properties Corporation and return to regular session of the Mason County Fiscal Court.

Motion by Judge/Executive Gallenstein and seconded by Commissioner Finn to accept the business of the Public Properties Corporation and to reopen the regular meeting of the Mason County Fiscal Court.
Motion by Commissioner Finn and seconded by Commissioner Tumey to approve the purchase and installation of a new insulated rolling steel door for the Recycling Center from Overhead Door at a cost of $4,671.00.
1. Kentucky Gateway Museum Center Architect Approval
Motion by Judge/Executive James L. Gallenstein and seconded by Commissioner Finn to approve DS2 Architects to perform the architectural work on the old section of the Kentucky Gateway Museum at a cost of $6,500 and to further approve the signing of all necessary documentation and payment thereof when due.
2. Buffalo Trace District Health Department Contract
Motion by Commissioner Tumey and seconded by Commissioner Finn to enter into a contract with the Buffalo Trace District Health Department to provide Hepatitis B, Tetanus and Diphtheria vaccines for employees at a cost of $35 per employee per each dose administered.
3. Resolution 09-21 / Buffalo Trace Regional Hazard Mitigation Plan
Motion by Commissioner Finn and seconded by Commissioner Tumey to approve Resolution 09-21 adopting the Buffalo Trace Regional Mitigation Plan for the preparation and mitigation of natural hazards such as flooding, tornados, severe storms, et cetera.
4. Resolution 09-22 / $300,000 Bank of Maysville Loan
Motion by Commissioner Finn and seconded by Commissioner Tumey to approve Resolution 09-22 in regard to the borrowing of $300,000 from the Bank of Maysville to fund the completion of Phase IV and Phase V of the Maysville-Mason County Landfill and to further authorize the signing of all necessary documentation related to such loan.
There being no further business, motion was made by Commissioner Finn and seconded by Commissioner Tumey to adjourn the October 13, 2009 meeting of the Mason County Fiscal Court.
