Mason County Fiscal Court Regular Session September 15, 2009 9:00 a.m.
The meeting was called to Order by Judge/Executive James L. Buddy Gallenstein. Present were Commissioner F. J. Bear Finn (District 2), Commissioner Patrick McKay IV (District 1). County Treasurer Kim Muse, and Assistant County Attorney Jackie Sue Wright. Media from The Ledger Independent was also present.
Motion by Commissioner McKay and seconded by Commissioner Finn to approve the minutes of the August 11, August 27, August 31 and September 3 meetings as presented.

Road Department
Motion by Commissioner McKay and seconded by Commissioner Finn to accept the Road Department Report as presented.
Motion by Commissioner Finn and seconded by Commissioner McKay to approve Resolution 09-18 accepting the dedication of Tobacco Road as a public way and shall hereinafter include this roadway within the County Road System. A copy of the deed has been recorded.
Motion by Commissioner Finn and seconded by Commissioner McKay to approve Order 09-06 to transfer $150,000 from General Fund to Jail Fund, and $25,000 from General Fund to Solid Waste Fund as needed.
Motion by Commissioner Finn and seconded by Commissioner McKay to authorize the County Judge/Executive, County Attorney and County Treasurer to secure a loan in the amount of $300,000 at the lowest possible interest rate and to further authorize the signing of necessary documentation pertaining to such.
Sheriff Boggs submitted the attached August, 2009 Monthly Vehicle Reports for review.
Landfill Report
Motion by Commissioner Finn and seconded by Commissioner McKay to accept the August, 2009 Landfill Report as presented by Todd Leonard, Landfill Manager.
Mr. Leonard advised the Court that bids were received for a new / used backhoe on September 4, 2009.
Upon the recommendation of Mr. Leonard, motion by Commissioner McKay and seconded by Commissioner Finn to purchase the 2009 Case 580SM from Wilson Equipment Company in the amount of $65,899.27.
Motion by Commissioner McKay and seconded by Commissioner Finn to authorize payment of ½ of the invoice for the above referenced backhoe upon delivery and to secure financial arrangements for the balance to be paid in January, 2010.
Motion by Commissioner Finn and seconded by Commissioner McKay to accept the August, 2009 Recycling Center Report as presented by Steve Frodge, Recycling Center Manager.
Mr. Frodge advised the Court of several pending maintenance issues which include replacement of the roll-up door, replacement of the can-crusher and annual maintenance of the furnace.
Detention Center Report
Motion by Commissioner Finn and seconded by Commissioner McKay to accept the August, 2009 Detention Center Report as presented by Jailer Gerald Curtis.
Jailer Curtis reported that, due to the age of the Detention Center Facility, repairs and maintenance of several significant building components could be expected in the near future. Repairs to the air conditioning until are expected to cost $3,400 plus labor.
Animal Shelter
Motion by Commissioner McKay and seconded by Judge/Executive Gallenstein to accept the Animal Shelter report as presented and attached hereto.
Judge Gallenstein advised that he had met with a core Census committee comprised of Jeri Compton (District Census Representative), Jim Meadows (who shall serve as the Coordinator), Ray Young, Matt Wallingford and Sarah Anderson. The purpose of this committee is to publicize Census 2010 to insure the increased awareness of and participation in the upcoming Census. Membership of the core committee decided to expand membership to include the Chamber of Commerce, RSVP, Aging Council, Schools, Extension Agency and Adult Day Care.
There being no further business, motion was made by Commissioner Finn and seconded by Commissioner McKay to adjourn the September 15, 2009 meeting of the Mason County Fiscal Court.
