Mason County Fiscal Court Regular Session August 11, 2009 9:00 a.m.
The meeting was called to Order by Judge/Executive James L. “Buddy” Gallenstein. Present were Commissioner Donald Tumey (District 3), Commissioner F. J. “Bear” Finn (District 2), Commissioner Patrick McKay IV (District 1), Sheriff Patrick Boggs, County Treasurer Kim Muse, County Attorney John F. Estill and Assistant County Attorney Jackie Sue Wright. Media from The Ledger Independent and WFTM were invited but not in attendance.
Motion by Commissioner McKay and seconded by Commissioner Tumey to approve the minutes of the July 14, 2009 meeting as presented.
Judge Gallenstein advised the Court that he had been notified by Governor Steven Beshear that Mason County would be receiving $123,752.00 from the 2010 Rural Secondary Road Fund allotment to meet the most critical of rural highway needs. Upon careful review, Judge Gallenstein submitted the following recommendations for inclusion to the 2010 Rural Secondary Program:
Sheriff Patrick Boggs advised the Court that there were no Tax Disbursements for July, 2009.
Sheriff Boggs submitted the attached July, 2009 Monthly Vehicle Reports for review.
Landfill Report
Motion by Commissioner Finn and seconded by Commissioner Tumey to accept the July, 2009 Landfill Report as presented by Todd Leonard, Landfill Manager.
SimplexGrinnell Life Safety Agreement Motion by Commissioner McKay and seconded by Commissioner Finn to approve the SimplexGrinnell Life Safety Agreement in the amount of $4,111.00 for the period extending from October 1, 2009 through September 30, 2010.
Hobart Service Agreement Motion by Commissioner McKay and seconded by Commissioner Tumey to approve the Hobart Service Agreement in the annual amount of $896.40 for service of the kitchen appliances.
1. Resolution 09-14 Motion by Commissioner McKay and seconded by Commissioner Finn to approve Resolution 09-14 regarding the inclusion of unincorporated areas in Mason County, Kentucky within the City of Maysville’s Proposed Facilities Plan.
2. Resolution 09-15 Motion by Commissioner McKay and seconded by Commissioner Finn to approve Resolution 09-15 authorizing the acquisition, construction and installation of landfill improvements for the solid waste system operated by County of Mason, Kentucky; authorizing the execution and delivery of a fourth supplemental lease in the principal amount of $300,000 to provide part of the costs of said acquisition, construction and installation; providing for the terms and conditions upon which said fourth supplemental lease is to be executed; and authorizing certain other actions in connection with the execution of said fourth supplemental lease.
A Special Meeting of the Mason County Fiscal Court has been scheduled for 1:00 p.m. on August 20, 2009 for the purpose of setting the 2009-2010 Tax Rates.
There being no further business, motion was made by Commissioner Finn and seconded by Commissioner McKay to adjourn the August 11, 2009 meeting of the Mason County Fiscal Court.
